Who is the data controller for the information I provide?

Liverpool City Council is the data controller for the information you provide to us.

Why we are collecting your data?

We collect and hold information about you in order to provide:

  • Service delivery.
  • Service improvement, planning and performance.
  • Prevention and detection of crime and disorder.
  • Research and evaluation using anonymised data only

What is the legal basis for processing your information?

We process personal data such as name, address and date of birth. The processing is necessary for the service to perform its legal obligations in line with the Crime and Disorder Act 1998 and tasks in the public interest. We process some special category data, i.e. gender, ethnicity, religion, and health related data.  This processing is necessary for reasons of substantial public interest, on the basis of law, in respect of data protection rights and provide appropriate measures to safeguard your rights and interests.

Article 6 of the GDPR allows Liverpool’s Safer and Stronger Communities Service to process your information in view of the authority’s legal obligations. Articles 9 and 10 of the GDPR allows us to process your information without consent for the purposes of providing information within the public interest and vital interests of individuals. Whilst this will also cover preventative and sign posting services we will always contact you for your explicit consent if we require your information to be used outside this scope.

The information we may collect

We hold case information on people who may be victims or perpetrators of crime and anti-social behaviour, including hate crime, domestic abuse, serious organised crime or other offences.

Do I have to provide this information, and what will happen if I don’t?

Your data is essential for the Safer and Stronger Communities Service to support service delivery for you. Sometimes we are required by law to share information about you and we do not need to get your permission to do this. Examples might be to protect you or others against risk of harm or to prevent any future crimes.

Who will your information be shared with?

Your information may be shared with some of the following agencies:

  • Police
  • Registered providers
  • Fire and Rescue Service
  • Social care
  • Judicial Agencies e.g. Courts
  • Probation Service
  • Health agencies
  • Education providers
  • Universities and other independent evaluators
  • Other local authorities
  • Voluntary sector partners
  • Domestic Homicide Review Chairs/Authors
  • Custodial establishments
  • Department for Work and Pensions
  • Other local authorities directorates within Liverpool City Council

Even though we are required to share your information with authorised partner organisations, we will ensure this is done in a secure manner, and the information is proportionate in order for them deliver services to prevent and reduce crime and disorder.

These partners will also include organisations that we commission to provide services, such as home security or domestic abuse support services. You will hear these called providers. As they are delivering services on our behalf these organisations must keep your details safe and secure, and as the data controller we will make sure that they comply with our required information sharing standards and protocols.

We make every effort to keep all the personal data we hold secure, whether held electronically or as paper copies. We also ensure that only members of staff with a legitimate reason to access your information have permission to do so.

In certain cases, such as safeguarding inquiries and criminal investigations we are legally obliged to provide information to the police. We also have a statutory duty to undertake Domestic Homicide Reviews, for which we contract an independent Chair and Author. However we have procedures in place that allows this to be carried out in a secure and confidential manner.

How long will you keep this information for?

Your information will only be kept for a specific amount of time after which it will be securely destroyed. How will my information be stored?

All information is securely stored electronically on the Safer and Stronger Communities case management systems on Liverpool City Council’s secure network.

Source of the data if we are recipient and hold it for others

Your data may be passed to Safer and Stronger Communities by the agencies listed above such as police service, health service, children’s social care, education providers and voluntary sector providers.
