Taxi driver improvement scheme - course terms and conditions

Liverpool City Council’s Taxi Driver Improvement Scheme is governed by these terms of use, and by applying to attend a Driver Improvement Course (the “Course”) you consent to these Terms and Conditions. The Terms and Conditions are a legal agreement between you (as the Applicant) and Liverpool City Council and can only be modified with the prior written consent of Liverpool City Council.

Liverpool City Council reserves the right to change the terms and conditions at its discretion by changing them on online or in any other format. If you do not agree with any of the Terms and Conditions you should notify Liverpool City Council immediately and not apply to attend the Course

Introduction

In these Terms and Conditions “Applicant” shall refer to those individuals who Liverpool City Council (the “Council”) has offered to undertake the Course being:

  • individuals who have never been offered the Course before
  • individuals who have not attended a course in the previous three years

Pre-requisites 

By applying for the Course the Applicant acknowledges and accepts that they:

  • have considered the options placed before him by the Licensing Officer
  • are eligible to attend the Course and it has, where requested, demonstrated to the Council that it is eligible to attend the course
  • are doing so having made an informed decision as to the consequences of attending the Course
  • are advised by the Council to consider seeking independent legal advice in relation to the implications of this course not provided by Liverpool City Council

Cost of the course

  • The cost is £100.00.
  • The Applicant accepts that the Council cannot refund payment for the Course at any time.

Date and changes to the course

The Council reserves the right to suspend, cancel, or modify the Course at any time, for any reason, and without notice.

If the Applicant wishes to change the date of their chosen Course they must contact drivertraining@liverpool.gov.uk at least 7 days prior to their Course date to confirm their intention and arrange attend another Course.

If the Course cannot be held for any reason at the time, date, or location originally specified by the Council the Applicant will, at no extra charge, be invited attend the course on another date. The Council shall not be liable for any loss suffered by the Applicant as a result of these changes.

If the applicant fails to turn up to the Course (without providing the Council with at least 7 days’ notice of non-attendance, then the officer responsible for this case may continue to issue a Summons for the original offence.

Other items

  • Liverpool City Council takes its commitments under the Equality Act 2010 very seriously and confirms its commitment to equality of opportunity in all areas. All Applicants will be treated in a fair and equal manner and in accordance with the law regardless of gender, marital status, race, religion, colour, age, disability or sexual orientation.
  • Where an Applicant suffers from a disability as defined under the Equality Act 2010 the Council shall endeavour to assist that candidate as much as is possible and will consider requests for reasonable adjustments in all cases.
  • The Council shall not be responsible for damages, losses or liabilities of any kind, including without limitation, direct, indirect or consequential loss or damages arising out of or in relation to the course. Nothing in these Terms and Conditions shall limit or exclude liability for death or personal injury as a result of the Council’s negligence.
  • If the Applicant is in breach of any of these terms and conditions, the Council reserves the right to either prohibit the Applicant attending the course.
  • Liverpool City Council is fully committed to complying with Data Protection Act 2018 legislation, including the General Data Protection Regulation (GDPR). As part of the course process, the Council may be required to use the Participants personal information and where necessary provide it to authorised third parties as part of the course process.   • These Terms and Conditions shall be governed by and construed in accordance with English law. Each party irrevocably agrees to submit to the exclusive jurisdiction of the courts of England over any claim or matter arising under or in connection with these terms and conditions.
  • The copyright and other intellectual property in material contained on Council materials including the course, including without limitation in text, images, questions and scripts is owned by the Council except where otherwise stated.
