Duty to consult on felling street trees

The 'Duty to Consult' legislation requires local authorities to consult with residents before felling street trees on urban roads.  This is so local people can express their views over the proposed management of street trees in their area and ensure a more transparent decision-making process.

In Liverpool, most trees that we fell would be exempt from the legislation as we're felling them for safety reasons. However, there may be times when we are considering felling a street tree.

Where we have a duty to consult, we will publish details of the trees we are proposing to fell and the reasons why below.  We will also post site notices on the trees to be felled.

We will only fell trees where it is absolutely necessary and we will always look for alternative courses of action before making a final decision.

How to comment

Where a notice invites you to comment you can do so in writing within 28 days of the notice publication date. In all correspondence, please quote 'Duty to consult', along with the tree site / location address.

What happens next?

All responses will be considered and a decision will be published on this website. A notice will also be attached to the tree.

If you object to the decision, you can appeal to the council within 14 days of the decision notice date for it to be reconsidered. Appeal details will be published on the decision notice.
