Personal licence course terms and conditions

Liverpool City Council’s Personal Licence Course (the “Course”) is governed by these terms of use, and by applying to attend the Course you consent to these Terms and Conditions. The Terms and Conditions are a legal agreement between you (as the Applicant) and Liverpool City Council and can only be modified with the prior written consent of Liverpool City Council. Liverpool City Council reserves the right to change the Terms and Conditions at its discretion by changing them online or in any other format. If you do not agree with any of the Terms and Conditions you should notify Liverpool City Council immediately and not apply to attend a Personal Licence Course.

Introduction

In these terms and conditions “Applicant” shall refer to those individuals who Liverpool City Council (the “Council”) has offered to undertake a Personal Licence Course being:

  • individuals who have never attended a course before 
  • individuals who have attended a course before but would like to refresh

Pre-requisites

By applying to the Course the applicant acknowledges and accepts that:

  • they have read and understood all information provided to it prior to applying to attend the Course.
  • their attendance on the Course is not by any means a guarantee that a ‘Licence for the Sale of Alcohol’ will be issued as this is governed by a separate application.

Cost of course

The Course shall cost £99.00 and for this the Applicant is entitled to attend the Course on the date chosen at the time of booking and complete the multi-choice exam once only.

The Applicant accepts that the Council cannot refund any payment unless request of refund is given a period of 28 days prior to the commencement of the Course.

Date and change to the course

The Council reserves the right to suspend, cancel, or modify the Course at any time (and for any reason) without notice.

If an Applicant wishes to change the date of their Course they must contact personallicence@liverpool.gov.uk at least 7 days prior to the Course to confirm their intention of amending the Course date and to arrange to attendance at another Course.

If a Course cannot be held for any reason at the time, date, or location originally specified by the Council the Applicant will, at no extra charge, be invited attend the Course on another date.  The Council shall not be liable for any loss suffered by the Applicant as a result of these changes.

If the applicant fails to turn up to the course (without providing the Council with at least 7 days’ notice of non-attendance), the place shall be forfeited, and no refund shall be given. In the event of this if the Applicant still wishes to attend a Course the full fee shall be payable.

Course results - pass or fail

Results will be issued on the first Monday following the date of the Course.

On successful completion of the exam, the award will be applied for and on receipt forwarded to the applicant via recorded delivery to the address recorded on the application.

An award will ALWAYS be issued to the Applicant and not to any third party or company/organisation regardless of how payment was made.

An exam ‘Fail’ will result in a further attempt to pass being made at a time and location agreed between both parties.

A resit fee of £30.00 will become payable where an Applicant wishes to make a further attempt.

Other items

Liverpool City Council takes its commitments under the Equality Act 2010 very seriously and confirms its commitment to equality of opportunity in all areas. All Applicants will be treated in a fair and equal manner and in accordance with the law regardless of gender, marital status, race, religion, colour, age, disability or sexual orientation.

Where an Applicant suffers from a disability as defined under the Equality Act 2010 the Council shall endeavour to assist that candidate as much as is possible and will consider requests for reasonable adjustments in all cases.

The Council shall not be responsible for damages, losses or liabilities of any kind, including without limitation, direct, indirect or consequential loss or damages arising out of or in relation to the course.  Nothing in this condition shall limit or exclude liability for death or personal injury as a result of the Council’s negligence.

If the Applicant is in breach of any of these Terms and Conditions, the Council reserves the right to either prohibit the Applicant attending the course

Liverpool City Council may change its awarding body at any time.

Liverpool City Council is fully committed to complying with Data Protection Act 2018 legislation, including the General Data Protection Regulation (GDPR). As part of the course process, the Council may be required to use the Participants personal information and where necessary provide it to authorised third parties as part of the course process.  More information about how the Council processes the Applicants personal data can be found at liverpool.gov.uk/privacy-notice/.

These Terms and Conditions shall be governed by and construed in accordance with English law. Each party irrevocably agrees to submit to the exclusive jurisdiction of the courts of England over any claim or matter arising under or in connection with these terms and conditions.

The copyright and other intellectual property in material contained on Council materials (including the course), including without limitation in text, images, questions and scripts is owned by the Council except where otherwise stated.
